JUSTICE SUDHIR SINGH ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case, in short, is that on 20.08.2019 at 9 p.m. when the informant was at his home, a child was came there and informed him that someone shot at his father near railway gumti. Informant reached near the vehicle and found his father lying seriously injured inside the vehicle and oozing out blood from his mouth, neck, head. The informant claimed that his father was shot by fire arm while returning from his clinic. It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.14503 of 2020(2) dt.02-03-2020 2/2 the petitioner is in custody since 18.10.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. No specific overt act is alleged against the petitioner. No incriminating article is recovered from the possession of the petitioner.

On behalf of the State and counsel for the informant, it is submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Vaishali at Hajipur in connection with Goraul P.S. case No.293 of 2019.
