Petitioner apprehends arrest in a case registered for the offences punishable under Section 25(1-b)A/26 of the Arms Act.

As per prosecution case, one counter made katta has been recovered from the motorcycle which is alleged to have been left by the petitioner.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implication in the present case. Moreover, it is apparent from the F.I.R. that there is no recovery of arms from the possession of the petitioner and motorcycle in question does not belong to the petitioner. Petitioner has got clean antecedent.

No.15370 of 2023(2) dt.18-05-2023 2/2 Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Korha P. S. Case No. 523 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
