JUSTICE ARUN KUMAR ORAL ORDER 20-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 26.3.2018 seeks bail in Birpur (Bhim Nagar O.P.) PS Case No. 28 of 2018 (Special Case No. 1 of 2018) registered under Section 23(a) of the NDPS Act. The allegation in brief is that 5 - 6 injection amples of Diazelah and Phennergan psychotropic drugs worth Rs. 772 was recovered from the possession of the petitioner. Learned Counsel for the petitioner submits that the petitioner had purchased those drugs for treatment of a patient on medical prescription, he has no criminal antecedent and is in custody since 26.3.2018.

Having considered the said facts and circumstances, the petitioner, namely, Ram Prasad Rai is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Supaul in connection with Birpur (Bhim Nagar O.P.) PS Case No. 28 of 2018 (Special Case No. 1 of 2018).
