The petitioners seek bail in Beldour P.S. Case No. 196 of 2017 registered for the offence punishable under Sections 363, 366A/34 of the Indian Penal Code.

Informant is the father of the victim, who in his statement on 25.09.2017 has alleged that his daughter Anjani Kumari aged about 14 years came to perform Durga Puja in Beldour and while she was returning, three boys on motorcycle including the petitioners have kidnapped her minor girl. Subsequently, the girl was recovered and in her statement recorded under Section 164 of the Cr.P.C, she has named Avinash and Akshay who had committed rape on her and has

Patna High Court Cr.Misc. No.6948 of 2018(3) dt.07-03-2018 2/2 not made any allegation against the petitioners except that they were also present when she was being taken away from the motorcycle. Petitioners have got no criminal antecedent and are in custody since 11.11.2017 and 09.10.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Khagaria, in connection with Beldour P.S.
