JUSTICE SUDHIR SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 352 353 and 34 of the Indian Penal Code.

The informant Akhilesh Kumar, Revenue Clerk, Madhubani, has alleged in the FIR that the petitioners have disturbed in measuring the land of Gairmajarua Aam way appertaining to Khata no. 164, Khesra No. 811 for which Halka Karamchari/Anchal Amin was deputed.

It has been submitted on behalf of the petitioners that while land was being measured by the concerned authority, the petitioners had protested and created hindrance in course of measurement being made by the authorities concerned. It has

The case has been instituted against the petitioners due to mistake of fact. It is further submitted that other co-accused has been granted anticipatory bail by this Court.

On behalf of the state, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani, in connection with Kaluahi P.S.Case No. 57 of 2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
