JUSTICE SANJAY PRIYA ORAL ORDER 07-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Khodawanpur P.S. Case No. 56 of 2017 instituted for the offence under Sections 461 and 379 of the Indian Penal Code.

It has been submitted that petitioner is a lady. She has no criminal antecedent. Her name has come in the confessional statement of co-accused Abhinav Kumar made in paragraph-46 of the case diary. He has stated in his confessional statement that his brother Raja Kumar and Manish Kumar have committed theft in the shop of Mohan Mobile, and, thereafter, police recovered some Mobile phones from the house of Manish as mentioned in paragraph-51 of the case diary. Thereafter, the petitioner was also made accused. In this manner, there is no recovery from

Patna High Court Cr.Misc. No.37366 of 2017 (2) dt.07-08-2017 2/2 conscious possession of the petitioner.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Manjhaul, Begusarai, in connection with Khodawanpur P.S.
