Petitioner seeks bail in Town P.S. Case No.62 of 2019 instituted for the offence under Section(s) 30(a), 38 and 41 of Bihar Prohibition and Excise Act, 2016. As per written report, 122.895 litres foreign liquor has been recovered from the house of petitioner. Counsel for the petitioner submits that petitioner has clean antecedents. The seizure list does not bear signature of the petitioner. Seizure list is part of the First Information Report, which bears signature of wife of petitioner.

Petitioner is in custody since 23.01.2019.

In the facts and circumstances of the case, prayer of

Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur, in connection with Town P.S. Case No.62 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
