JUSTICE ARUN KUMAR ORAL ORDER 16-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Kasim Bazar P.S.Case No. 165 of 2017 registered under Sections 147,148, 149, 341, 302 and 120B of the Indian penal Code and Section 27 of the Arms Act.

Allegation in brief is that mother of the informant was killed, on the way while she was coming, by the miscreants for the reason that his mother was an eye witness in a murder case of his brother and Pawan Mandal was threatening to compromise in the case, therefore, she was eliminated by criminals in conspiracy with the petitioner, the step mother of the informant. Submission is that threatening was being given by one Pawan Mandal and not by this petitioner, she was also an accused in that case and she has been implicated being step mother and

Patna High Court Cr.Misc. No.6582 of 2018 (2) dt.16-02-2018 2/2 some other co-accused persons have been admitted to bail by a coordinate Bench of this Court vide order dated 09.11.2017 passed in Cr. Misc. No. 51958 of 2017 and vide order dated 12.12.2017 passed in Cr. Misc. No. 58084 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Baby Devi is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Munger in connection with Kasim Bazar P.S. Case No. 165 of 2017 with condition that one of the bailors must be her close family member. She will not made any inducement or threat to the witnesses or tamper with the evidence. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, her bail bond shall be liable to be cancelled.
