JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-04-2015 Heard learned counsels for the petitioners and the State. The petitioners being maternal grand mother and mother of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant after 3 years of marriage for non fulfillment of dowry demands. The informant has claimed that on 19.5.2014 she came to know that her daughter has been put on fire then she reached to the village of the inlaws of the victim and found her in seriously burnt condition and took her to Sadar Hospital, Araria from where she was referred to Katihar and from there to PMCH but the victim

It is submitted by the learned counsel for the petitioners that the accusation is omnibus and general against the entire family. The postmortem report reflects the death due to septicemia as a result of 90% burn injury and it was the accused side who tried to provide medical assistance to the victim. Considering the accusation being omnibus and general and the petitioners being old ladies, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Kishanganj in connection with Terhagachh P.S. Case No. 64 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
