JUSTICE ARUN KUMAR ORAL ORDER 17-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.9.2017, seeks bail in East Colony PS Case No. 48 of 2016 registered under Sections 366A, 376, 354(D)/34 of the IPC and Section 6 of the Pocso Act. The allegation in brief is that the petitioner as a tutor used to teach informant's minor daughter and on the alleged date of occurrence he enticed away the girl and committed rape. Learned Counsel for the petitioner submits that the FIR was lodged after a lapse of two days.
Whereas learned Counsel for the State submits that there is allegation of enticing away the minor girl of the informant of 14 years and she has made statement that she was raped by the petitioner.
Having considered the aforesaid facts and circumstances, the prayer for bail of the petitioner is rejected. Snkumar/- (Arun Kumar, J) U T
