The petitioner seeks bail in Gogri P.S. Case No. 112 of 2018, instituted for the offence under Section(s) 302/34 of Indian Penal Code.

In the written report it is alleged that informant on the date of occurrence at 2:00 a.m. woke up and saw the petitioner with other accused persons running away from the house of her Dewar Gulo Yadav. The informant reached at the house of her Dewar and found him lying dead on the ground. It is further alleged that wife of her Dewar had illicit relation with accused persons. Therefore, they have committed murder of Gulo Yadav.

Counsel for the petitioner submits that mere

Patna High Court CR. MISC. No.18821 of 2019(2) dt.28-03-2019 2/2 suspicion has been raised against petitioner in the written report. Petitioner has clean antecedent. He further submits that other co-accused have already been granted bail by this Court and coordinate Bench of this Court vide orders dated 15.01.2019 and 20.11.2018 passed in Cr. Misc. 77511 of 2018 and 64354 of 2018 respectively.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Gogri P.S. Case No. 112 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
