JUSTICE SANJAY PRIYA ORAL ORDER 04-10-2017 Heard learned counsel for the petitioner and the State. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 28.01.2017 passed in Cr. Misc. 53715 of 2016 in which the trial court was directed to expedite the trial.
The report has been called for from the trial court which has been received. The trial court has submitted in the report that the case is pending for evidence. Learned counsel for the petitioner has submitted that evidence of the informant has already been completed and total two witnesses have been examined in this case. He has further submitted that petitioner is in custody since 06.09.2016. In such circumstances, since the petitioner is in
Patna High Court Cr.Misc. No.46497 of 2017 (3) dt.04-10-2017 2/2 custody, from 06.09.2016, the court below is directed to expedite the trial of the petitioner by giving short adjournment in the case and make efforts to conclude the same within a period of six months from the date of receipt of this order. Petitioner is given liberty to renew his prayer for bail in the court below itself in the event trial is not concluded within six months and in that event, the court below will give reason in the order for not concluding the trial within six months. With aforesaid observation, the application stands disposed off.
