This writ application has been filed for issuance of direction to the respondent authorities to exclude the land of the petitioner measuring 9 Khata 17 Dhurs appertaining to Tauzi No. 3653, Thana No. 166, Khata No. 229, Khesra No. 1262 situated at village Ghaghra which has been declared surplus land of Late Mahanth Bharat Das of Rampur Astha by the District Gazette notification dated 16.01.1992 vide Land Ceiling Case No. 01. of 1973-74 without holding any inquiry under

Patna High Court CWJC No.9264 of 2021(3) dt.12-12-2023 2/2 Section 5 (i)(iii) of Ceiling Act by the Collector (Annexure-1).

3. After some argument learned counsel for the petitioner requests disposal of writ petition with direction to the Collector, Begusarai (Respondent No. 2) to dispose of the jamabandi cancellation vide Misc. Appeal No. 26/2021 filed by the brother of the petitioner which is still pending before the Collector, Begusarai.

4. In view of the prayer made by the petitioner, this writ petition is disposed of with direction to the Collector, Begusarai (Respondent No. 2) to dispose of the aforesaid Misc. Appeal No. 26/2021 in accordance with law after hearing the parties, preferably, within a period of six months from today

5. Writ petition is disposed of with the aforesaid direction.
