2. Perused the impugned order dated 05.09.1994/03.10.1994 passed by Collector, Vaishali, Hajipur in R.M.S. Case No. 68/93-94, Annexure-4, whereunder it has been held that the writ petitioner is not the bataidar of the lands-in-question as there is no document on record to show that he was ever bataidar of the lands-in-question or divided the produce grown on the disputed land with the landlord. Having held as above, District Collector set aside the order passed by the D.C.L.R.

3. I see no jurisdictional error in the impugned order. The writ petition is dismissed. (V.N. Sinha, J) P.K.P.
