The petitioner is in custody since 25.05.2017 in connection with Bihpur (Bhawnipur) P.S. Case No. 361 of 2014 for the offence registered under Sections 364(A) and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the name of the petitioner has surfaced in connection with the present case on the basis of the statement made by the co-accused before the police, which has no evidentiary value.

Considering the fact that the petitioner is not named in the first information report and till date, he has not been put on T.I. Parade and there being no other material but the confessional statement made before the police, let the petitioner, above named,

Patna High Court Cr.Misc. No.48529 of 2017 (2) dt.17-10-2017 2/2 be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional District and Sessions Judge, Naugachia in connection with Bihpur (Bhawanipur) P.S. Case No. 361 of 2014.
