====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sonpur (Hajipur) P.S. Case No. 01 of 2018, registered under Section 30(a) and 41 of the Bihar Prohibition and Excise Act, 2016.

The accusation is of apprehending of the petitioner and two others by the Police in running train with four trolly bags in which 190 bottles, each containing 750 ML India made foreign liquor were kept.

Learned counsel for the petitioner submits that the petitioner, who is travelling in the train, has falsely been implicated in this case mere on suspicion showing recovery of

Patna High Court Cr.Misc. No.17148 of 2018(2) dt.28-03-2018 2/2 seized trolly bags in which liquor was kept. The petitioner has no criminal antecedent and he is in custody since 04.01.2018. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. District and Sessions Judge-II-cumSpecial Judge (Excise), Vaishali at Hazipur, in connection with Sonpur (Hajipur) P.S. Case No. 01 of 2018.
