Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.
Petitioner is not named in the first information report but in course of investigation, when the further statement of informant was recorded, informant claimed that deceased was working with the petitioner and he had deposited his earning with petitioner. Informant further claimed that on the alleged date of occurrence, deceased left his home saying that he was going to collect his money from the petitioner. Furthermore, in
Patna High Court CR. MISC. No.14245 of 2019(3) dt.21-05-2019 2/2 course of investigation, some witnesses claimed to have seen the deceased in the company of petitioner prior to alleged occurrence.
Admittedly, none had seen the actual killing of the deceased and except the above stated circumstances, there appears to be nothing against the petitioner, who is languishing in jail custody since 25.10.2018.
Accordingly, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.
