ANJANA MISHRA ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody since 08.12.2016 in connection with Dulhin Bazar P.S.Case no. 235 of 2016 registered under Sections 364, 302,201m 120B and 34 of the Indian Penal Code.

Considering the fact that the petitioner has no criminal antecedent and his name has surfaced on the confessional statement of co accused before the police, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge,VIIth, Danapur in connection with Dulhin Bazar P.S.Case No. 235 of 2016 (S.T.No. 368 of 2017)subject to the following conditons:

Patna High Court Cr.Misc. No.48701 of 2017 (2) dt.18-10-2017 2/2 (i) that one of the bailors shall be a close relative of the petitioner.

(ii) that the petitioner shall not indulge in similar offences till conclusion of the trial.

(iii) that the petitioner shall remain physically present in Court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bonds shall be liable to be cancelled by the learned court concerned.

(iv) that the petitioner shall co-operate with the trial and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
