JUSTICE SANDEEP KUMAR ORAL ORDER 28-01-2022 Heard the parties through video conferencing. The petitioners apprehend their arrest in connection with Sheikhpura (Hathiyawan) P.S. Case No. 351 of 2020 registered for the offences punishable under Sections 341, 323, 325, 354(B), 307, 379, 504/34 of the Indian Penal Code. For occurrence dated 20.12.2019, the complaint was filed on 06.01.2020. Though the injuries have been caused on the head of the injured but the nature of injuries is not available on record.
The prayer for anticipatory bail of the petitioner no. 1 has been withdrawn, as he has died.
Patna High Court CR. MISC. No.25252 of 2021(5) dt.28-01-2022 2/2 Accordingly, the present application is dismissed as withdrawn as against petitioner no. 1 namely, Ghuna @ Manohar Bind.
So far as petitioners no. 2 and 3 are concerned, petitioner no. 2 is a lady and petitioner no. 3 is her son. Considering the delay in filing of the complaint, this application for grant of anticipatory bail is allowed. Accordingly, let the petitioners no. 2 and 3 namely Ramiya Devi and Mithu Kumar be released on bail, in the event of their arrest or surrender before the court below within a period of ten weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura (Hathiyawan) P.S. Case No. 351 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sandeep Kumar, J) Anand Kr./Saif U T
