The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 332, 307, 353, 427, 337, 120B of the Indian Penal Code and 3 of the Prevention of Damage to Public Property Act, 1984.

It is alleged that on receiving the information that one lady is being assaulted treating her to be a Witch, the police reached to the place of occurrence then the accused persons pelted stones and damaged the police jeep. It is submitted by the learned counsel for the petitioner that accusation is omnibus and general against mob and for the occurrence of 05.06.2014 at 11.00 A.M. the First Information Report was registered on 05.06.2014 at 2.00 P.M.

Patna High Court Cr.Misc. No.20492 of 2015 (2) dt.01-05-2015 and the First Information Report reached to the learned court below on 07.06.2014, which suggests that First Information Report was registered by ante dating.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran in connection with Sangrampur P.S. Case No. 57 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
