2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 381/34 of the Indian Penal Code.

3. It is alleged that this petitioner committed theft in the house of informant and stole huge amount of cash and jewellery. One day when informant got to know about the petitioner and confronted him, petitioner admitted his guilt and assured informant to return the money but he did not return it.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. No stolen articles were recovered from the possession of this petitioner and he has been made accused only on suspicion. Petitioner claims clean antecedent.

However, learned A.P.P. for the State vehemently opposed the bail application and submitted that there is specific and direct allegation that this petitioner committed theft and thereafter, he took three months' time to return the money but never returned the same. The aforesaid theft has also been admitted by the petitioner on stamp paper.

6. Considering the aforesaid facts and circumstances of the case, prayer for anticipatory bail of the petitioner is refused.
