The petitioner seeks regular bail in connection with Town P.S. Case No. 377 of 2018 registered for the offence punishable under Section 436 of the Indian Penal Code. The allegation is regarding the shop of the informant having been gutted in fire and further the motorcycles parked there had also been burnt.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case merely on suspicion and his name has come during the course of statement made by one of the witnesses standing near the place of occurrence who is said to have seen the petitioner smoking
Patna High Court CR. MISC. No.13861 of 2019(2) dt.06-03-2019 2/2 cigarette and fleeing away from the place of occurrence. It is further submitted that the petitioner has a clean antecedent and there is absolutely no material whatsoever to connect the petitioner with the alleged crime. Lastly, it is submitted that the petitioner is languishing in custody since 22.12.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned I/C C.J.M., Aurangabad in connection with Town P.S. Case No. 377 of 2018.
