JUSTICE SUDHIR SINGH ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 399, 402 and 44 of the Indian Penal Code.

Allegation against the petitioner is that five to six persons including this petitioner were preparing to commit dacoity and on seeing police party they fled away except one accused. It is submitted on behalf of the petitioner that he has got no criminal antecedent. He was not apprehended on the spot. His name has come on the basis of confessional statement of the coaccused, namely, Bablu. The motorcycle in question belongs to father of the petitioner and the same is not a stolen property. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief
