Mr. Sri Ram Anurag Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-04-2018 Heard learned counsel for the petitioner, the learned APP for the State as well as the learned counsel appearing on behalf of the informant.

Petitioner, already in custody, seeks bail in connection with Durgawati P.S. Case No.192 of 2017, registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that the accused persons followed the husband of the informant on a motorcycle and thereafter killed him by shooting at him.

Learned counsel for the petitioner submits that the informant is not the eye witness, two persons, namely, Tahlu and Banti Singh were apprehended and they have made confessional

No.10890 of 2018(3) dt.10-04-2018 2/2 statement and according to them Tahlu himself and Radheshyam shot at the deceased and only two firearm injuries are found on the person of the deceased, there is no motive of the petitioner for killing the deceased and the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Chandan Sah @ Chandan Jaiswal is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhabua, Kaimur in connection with Durgawati P.S.
