26-07-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Muffassil P.S. Case No. 275 of 2020, registered for the offence under Sections 302, 120(B)/34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other FIR named accused persons committed the murder of sister of the informant on account of alleged illicit relation between co-accused Aamir Miya (husband of sister of informant) and petitioner.

It is submitted on behalf of petitioner that there is general and omnibus allegation against all the accused persons and no specific allegation of assault against this petitioner. Specific allegation is against co-accused Amir Miya, who is husband of the deceased, and he is alleged to have committed

Patna High Court CR. MISC. No.24824 of 2021(2) dt.26-07-2021 2/2 murder of deceased by tying knot in her neck. Petitioner, who is lady, has got clean antecedent and she is in custody since 25.08.2020.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Judicial Magistrate Sadar Motihari, East Champaran in connection with Muffassil P.S. Case No. 275 of 2020, on the following conditions: "(1) Petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the court below and shall remain physically present, as directed by the court below, and on her absence on two consecutive dates without sufficient reason, her bail-bond shall be cancelled by the court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
