BAJANTHRI) 28-08-2023 The present M.J.C.- Contempt Petition is filed for non-compliance of the order dated 22.06.2006 read with order dated 22.01.2001 (Annexure-1 and 2 respectively).
2. Learned counsel for the petitioner submitted that from time to time the concerned respondents have complied the orders of this Court in part. Thereafter, there were protracted correspondence among the University and the State. It is submitted that the University keep on proposing to the State
Patna High Court MJC No.705 of 2020(7) dt.28-08-2023 2/2 Government and the State Government is requesting one or other documents including the latest proposal. These materials cannot be taken into consideration so as to entertain the present contempt petition insofar as non-compliance of the order dated dated 22.06.2006 read with order dated 22.01.2001 (Annexure-1 and 2 respectively) in the year 2020. If there is any partial compliance of the aforesaid orders in that event contempt petition should have been initiated within one year. If the concerned respondent fails to comply certain portion of the order dated 22.06.2006 read with order dated 22.01.2001 (Annexure-1 and 2 respectively), cause of action accrued in the year 2007. Having regard to these many years of delay, the present contempt petition cannot be pursued further. Accordingly, the present M.J.C.- Contempt Petition stands dismissed in the light of order dated 24.07.2023 passed in C.W.J.C. No. 1840 of 2023 (Dr. Rajesh Kumar Sinha & Others Vs. The Union of India & Others).
