The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 18 liters of Nepali Wine were recovered from the possession of the petitioner. Petitioner claims his antecedent to be clean and he is in custody since 09.05.2017.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten
Patna High Court Cr.Misc. No.33731 of 2017() dt.20-07-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 7th -cum-Special Judge, Excise, East Champaran, Motihari in connection with Adapur P.S. Case No.122 of 2017.
Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
