ANJANA MISHRA ORAL ORDER 08-03-2018 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner has been in custody since 13.11.2017 in connection with Special Case No. 158 of 2017 arising out of Kotwali P.S. Case No. 555 of 2017 for the offence registered under Sections 413, 414, 34/411 of the Indian Penal Code and Section 18, 22 and 27 of the NDPS Act.
Learned counsel for the petitioner submits that no case under the NDPS Act is made out in view of the fact that except a black colored mobile, no other item has been recovered from his possession. It is further submitted that only on suspicion and his connection with one Prem Pandye @ Kanhaiya, the petitioner has been implicated in connection with the present case.

No.10140 of 2018 (3) dt.08-03-2018 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge - III-cum- Special Judge, C.B.I. 02, Patna in connection with Special Case No. 158 of 2017 arising out of Kotwali P.S. Case No. 555 of 2017.
