2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 399, 402, 411 of the Indian Penal Code.
3. Prosecution case, in brief, is that during course of patrolling near the mango orchard, informant found some suspected persons who tried to flee away after noticing the police party but four out of five persons were apprehended on the spot who disclosed the name of this petitioner.
4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he has been made accused only on the basis of confessional statement of co-accused persons.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Sikrahna at Dhaka, East Champaran in connection with Ghorasahan P. S. Case No. 78 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
