Mr. Yogendra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH CHAND MALVIYA ORAL ORDER 14-05-2025 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary.

2. The petitioner is in custody in a case registered for the offence punishable under Sections 395 and 412 of the Indian Penal Code.

3. As per allegation in the FIR, the informant alleged that eight miscreants by brandishing their weapon looted a cash of Rs.26,54,430/- from cash counter, Rs.6,880/- from Agree counter and Rs.18,00,000/- from the bank vault. It is further alleged that they also looted wallets, cash, debit cards and mobile phones of bank staffs and fled from there.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next

No.16864 of 2025(3) dt.14-05-2025 2/2 submits that petitioner is not named in the FIR and he is not present at the place of occurrence nor anything has been recovered from his possession. He next submits that similarly situated co-accused persons have already been granted bail by a Co-ordinate Benches of this Court passed in Cr. Misc. Nos.57607 of 2021 and 53466 of 2022 respectively. Petitioner is in custody since 08.08.2024.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

In view of the aforesaid facts and circumstances as also the fact that similarly situated co-accused persons have been granted bail by a Co-ordinate Benches of this Court, so I am inclined to grant regular bail to the petitioner. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XIV, Hajipur in connection with Sessions Trial No. 402 of 2022 arising out of Bidupur P.S. Case No. 56 of 2021.
