Mr. A.M.P. Mehta, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-08-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the state.

The petitioners seek pre-arrest bail in connection with Banka (Barahat) P.S. Case No. 814 of 2018 for the offences alleged under Sections 419, 420, 384, 386, 341, 342, 411, 427 and 120B of the Indian Penal Code and 3 of the Damage to Public Property Act.

The accusation is that in course of patrolling some persons were seen near Leevaran Hotel realizing the money from truck loaded with sand and chips. On chase one was apprehended, who disclosed his name as Sohaib and he also disclosed about realizing the money at Maharana Chowk, the informant reached there where also some persons were seen realizing the money. While they were chased, only one was apprehended, who disclosed his name as Hari Kishore Bambam. They also disclosed the names of 12 persons as their associates.

No.20533 of 2019(5) dt.01-08-2019 2/2 The submission of the learned counsel for the petitioners is that the petitioners were not apprehended on spot rather their names have come in the confessional statement Sohaib and Hari Kishore Bambam. Petitioners have no criminal antecedent.

Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Banka (Barahat) P.S. Case No. 814 of 2018 shall be released on pre-arrest bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
