The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act.

It is contended that as per allegation, 441 litres of foreign liquor were recovered from the truck which was being boarded by three persons including the petitioner. It is further contended that two co-accused namely Sunny Kumar and Manoj Kumar have been granted bail by different co-ordinate Benches of this Court by orders dated 14.06.2017 and 07.07.2017 passed

Patna High Court Cr.Misc. No.33952 of 2017() dt.20-07-2017 2/2 in Cr. Misc. Nos. 27002 of 2017 and 30638 of 2017 respectively. Petitioner claims that he is having clean antecedent and is in custody since 27.03.2017.

Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his (their) furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Spl. Ex 1242 of 2017 arising out of Khagaul P.S. Case No. 63 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
