JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioner seeks bail in connection with Tedhagachh P.S. Case No. 62 of 2016 registered for the offences punishable under section 302/34 of the Indian Penal Code. Allegation against the petitioner is that when the husband of the informant went to natural call towards river, thereafter informant heard hulla of her husband, upon this she alongwith her family members went towards the place of sound her husband was in injured condition.
Learned counsel for the petitioner submitted that he has been arrested on the basis of suspicion and there is nothing against him. The petitioner has been in custody for about 9 months.
Heard learned A.P.P. has opposed the prayer for bail
Patna High Court Cr.Misc. No.34865 of 2017 (2) dt.03-08-2017 stating that apart from confession he has eight other cases, all are serious in nature.
Having heard both sides, in view of the confession as well as criminal antecedent shows that he is accused in eight other cases, I am not inclined to grant bail to the petitioner. However, learned Judicial Magistrate, 1st Class, Kishanganj is directed to conclude the trial of the petitioner within a period of nine months. With the above observation, this application is dismissed.
