JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2017 This has come under the heading 'To Be Mentioned' for modification of order dated 7.8.2017 by which the appeal was disposed of.

It has been submitted by learned counsel for the appellant that in first paragraph of the said order 'Section 12 of POCSO Act' has been mentioned but the case was not instituted under POCSO Act.

From perusal of the record it appears that this case is not relating to POCSO Act, which has inadvertently been mentioned in the order.

Accordingly, the order dated 7.8.2017 stands modified to the extent that 'Section 12 of POCSO Act' shall not be treated as part of the order.

Let a copy of this order be communicated to the court concerned forthwith.
