Petitioner, already in custody, seeks bail in connection with Buxar Town P.S. Case No.667 of 2017, registered under Sections 25(1-b)a/26 of the Arms Act.
Allegation is that one country made pistol with two live cartridges were recovered from possession of the petitioner. It is submitted that the petitioner is diploma holder in engineering and has been falsely implicated in this case due to enmity and, the petitioner has no criminal antecedent and he is in custody since 14.11.2017.
Having considered the said facts and circumstances, petitioner Nitish Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two
Patna High Court Cr.Misc. No.12224 of 2018(2) dt.05-03-2018 2/2 sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Buxar Town P.S. Case No.667 of 2017, subject to the condition that the petitioner shall remain physically present on each and every date before the trial court and if he absents himself on two consecutive dates without reasonable cause, his bail bond shall liable to be cancelled.
