The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, it is stated that the informant received information on mobile phone that his brother had been done to death by the seven named accused persons including the petitioner herein as also Sipahi Rai and Santan Rai. Subsequently, the dead body of the informant's brother was recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. There are no eye witness to the occurrence. No material has transpired in course of investigation to connect the petitioner with the

Patna High Court CR. MISC. No.25106 of 2021(3) dt.15-12-2021 2/2 alleged crime. Co-accused Sipahi Rai and Santan Rai have been enlarged on bail vide order dated 9.3.2021 passed in Cr. Misc. No. 38211 of 2020. The petitioner who is a lady is in custody since 21.1.2021 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 10 months, chargesheet having been submitted in the case and grant of bail to the above named co-accused, the petitioner is directed to be enlarged on bail in connection with Lalganj P.S. Case no. 4 of 2020 (G.R. no. 36 of 2020) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Vaishali at Hajipur.
