====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 02-01-2023 Heard learned counsel for the petitioner and learned counsel for the respondent Zila Parishad, Bhojpur at Ara and learned APP for the State.

The present application has been filed for making payment of retiral dues amounting Rs. 98,203/- to the petitioner being the grand son of Late Dev Kumar Ram. During pendency of the writ petition, a letter vide Memo No. 791 dated 08.12.2022 has been served upon the counsel for the petitioner during winter vacation by which the claim of the petitioner has been rejected with a direction to obtain a succession certificate

Patna High Court CWJC No.7750 of 2021(4) dt.02-01-2023 2/2 from the competent court and then to claim reliefs according to rule. In this view of the matter, counsel for the petitioner submits that he seeks permission to withdraw the writ petition with liberty to move in accordance with law.

Learned counsel for Zila Parishad Bhojpur at Ara has annexed the office order dated 08.12.2022 which is on record as Annexure-B.

The present writ application has been permitted to withdraw and a direction has been given to the Zila Parishad that after obtaining the succession certificate, if the petitioner files the said claim then the Zila Parishad shall make payment within 3 months thereafter.

With this direction, this writ application is disposed off.
