The petitioner apprehends his arrest in connection with Chandauti P.S. Case No.183 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from possession of the petitioner rather recovery has been made from the bank of a river near Jamune village. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.18347 of 2023(2) dt.19-05-2023 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Exclusive Special Excise Judge, Court No.I, Gaya in connection with Chandauti P.S. Case No.183 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
