Mr. Kedar Jha, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 25-06-2025 Heard learned counsel for the petitioner, learned APP for the State, learned counsel for the informant and perused the case diary.

2. The petitioner seeks bail in connection with Patory P.S. Case No. 390 of 2024, instituted for the offences punishable under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The prosecution case, in short, is that, the petitioner along with other co-accused persons called informant's son at her house and killed him and concealed his dead body under the bed of her husband.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.17534 of 2025(4) dt.25-06-2025 2/3 petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner also submits that the petitioner is a lady and had illicit relationship with the deceased. It is next submitted that some other persons have killed the deceased and threw his dead body in her house because the door of her house was open. The petitioner is in custody since 12.10.2024 and has got no criminal antecedent. Learned counsel for the petitioner further submits that similarly situated co-accused has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 11.04.2025 passed in Cr. Misc. No. 15194 of 2025.

Learned APP for the State and learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner and submits that the dead body of the deceased was recovered from the house of the petitioner and incriminating articles were also recovered from her house. The petitioner is named in the FIR. It is further submitted that there is specific allegation levelled against the petitioner. Hence, the petitioner does not deserve the privilege of bail.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.17534 of 2025(4) dt.25-06-2025 3/3 of the case, nature of accusation and the gravity of the offence, this Court is not inclined to grant bail to the petitioner.

7. The prayer is rejected. The trial Court is directed to expedite the Trial.
