JUSTICE BIRENDRA KUMAR ORAL ORDER 06-09-2017 Heard learned counsel for the petitioner as well as learned counsel for the State.

The petitioner seeks bail in Bhagwanpur P.S. Case No. 129/2016, arising out of NDPS Case No. 10/2016 instituted for the offences under Sections 25(1-B)a/26 of the Arms Act and Sections 22/23 of the NDPS Act.

This is second attempt for grant of regular bail in NDPS Case No. 10/2016. From possession of the petitioner one country made pistol and 1kg ganja were recovered and for that the petitioner is in custody since 09.06.2016. The report of the learned trial Judge reveals that out of 10 prosecution witnesses, 4 prosecution witnesses have already been examined in this case. Learned court below is directed to conclude the trial

Patna High Court Cr.Misc. No.35583 of 2017 (3) dt.06-09-2017 2/2 within a period of six months from the date of receipt/production of a copy of this order.

If the petitioner would be cooperative in conclusion of the trial and the trial is not concluded within the aforesaid period, the petitioner will be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below .
