The petitioner seeks bail in connection with Jehanabad P.S. Case no. 865 of 2017 registered under Sections 30(a) of Bihar Prohibition & Excise Act-2016.

99.375 lts. of foreign liquor is said to have been recovered from Hyundai car and petitioner and driver of the vehicle were apprehended.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. He was simply commuter of the said vehicle and was going from Jehanabad to Arwal with consent of driver of the vehicle by paying fare for the same and had no knowledge of hiding the

Patna High Court Cr.Misc. No.7062 of 2018(2) dt.12-02-2018 2/2 liquor on the said vehicle. The petitioner has no criminal antecedent. Petitioner has been languishing in custody since 19.12.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum-Special Judge, Excise, Jehanabad in connection with Jehanabad P.S. Case no. 865 of 2017.
