The petitioners seek bail in anticipation of their arrest in connection with Kawakole (Rupo) P.S. Case No. 16 of 2020 instituted for the offences under Sections 147, 149, 323, 341, 308, 354, 379, 504 and 506 of the Indian Penal Code.
Patna High Court CR. MISC. No.24465 of 2021(2) dt.24-05-2022 2/3 The petitioners and others are said to have assaulted the informant and his associates while the work of construction was going on. The assault perpetrated by the accused persons including the petitioners has left three persons injured out of whom, two have received only simple injuries. The third of the victims has received injury on his hand which has been reported to be grievous in nature. It has been submitted on behalf of the petitioners that there is a counter version of the occurrence also in which some of the persons from the side of the petitioners have been injured and all the accused persons of the counter case have been granted anticipatory bail by a Bench of this Court.
Regard being had to background facts and there being case and counter case and the allegations against the petitioners being of general and omnibus in nature, they, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties
Patna High Court CR. MISC. No.24465 of 2021(2) dt.24-05-2022 3/3 of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Nawada in connection with Kawakole (Rupo) P.S. Case No. 16 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
