JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 376/34 of the Indian Penal Code and Section 8/12 of POCSO Act.
As per prosecution case, the maternal uncle of the informant is said to have committed rape against her with the help of her maternal aunt i.e. petitioner.
It has been submitted on behalf of the petitioner that the petitioner is a lady. It has further been submitted by the learned counsel for the petitioner that she never helped her husband for committing such offence. The petitioner is in custody since 21.04.2017.
Having considered the facts and circumstances of
Patna High Court Cr.Misc. No.34131 of 2017 (2) dt.20-07-2017 2/2 the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-I-cum- Special Judge (POCSO) Act, Sitamarhi, in connection with Bajpatti P.S.Case No. 129 of 2017.
