JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 1.9.2017, seeks bail in Khagaria (Chitragupta Nagar) PS Case No. 514 of 2017 registered under Sections 392 and 395 of the IPC.
It is submitted that the FIR is against unknown, recovery was made from another co-accused Abhimanyu Singh and except disclosure by Abhimanyu Sngh regarding his being associate there is no other material. It is further submitted that petitioner was not even put on TIP, he has no criminal antecedent except one case arising out of the present case in which the petitiner was found in possession of a country made pistol.
Having considered the said facts and circumstances, the petitioner, namely, Chetan Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri B. Kuimar, Judicial Magistrate, lst Class, Khagaria in connection with Khagaria (Chitragupta Nagar) PS Case No. 514 of 201 with the condition that the petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
