Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in connection with Muffasil Motihari P.S. Case No.12 of 2021, registered for the offences punishable under Sections 30(a)/32/41(1) of the Bihar Prohibition and Excise Act.

From the JCB of the petitioner liquor was recovered. Petitioner was not there at the time of recovery. The petitioner has got a criminal antecedent. In the said criminal case bearing Motihari Muffasil P.S. Case No.323 of 2019 an identical allegation was that from the car of the petitioner liquor was

Considering the nature of allegation and criminal antecedent of the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Hence, the prayer for anticipatory bail is refused. However, in the event of surrender of the petitioner within two weeks, the prayer for regular bail shall be considered without being prejudiced by the order of this Court.
