JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-04-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected vide order dated 22.06.2017 passed in Cr. Misc. No. 18003 of 2017, on the ground that the petitioner is in custody since 30.11.2016 and there is no progress in the trial and as such the petitioner deserves sympathetic consideration. The learned A.P.P. opposes prayer for bail of the petitioner by submitting that 3.400 kg of Charas was recovered from the motorcycle of the petitioner.

In the facts and circumstances stated above, finding no good ground for reconsideration of prayer for bail,

Patna High Court Cr.Misc. No.20616 of 2018 (2) dt.11-04-2018 2/2 again prayer for bail of the petitioner stands rejected in connection with Sessions Trial No. 29 of 2017 arising out of Kangali P.S. Case No. 37 of 2016 pending in the court of Additional District & Sessions Judge-5th, Bettiah, District- West Champaran. However, considering detention of the petitioner, the learned Sessions Judge is directed to expedite the trial and to conclude the same preferably within nine months.
