In this case, the petitioners are apprehending their arrest in connection with Kako P.S. Case No. 323 of 2018 registered for offences under sections 147, 148, 149, 323, 337,
Patna High Court CR. MISC. No.15419 of 2019(2) dt.13-03-2019 2/3 338, 307, 353, 379, 511, 333, 332, 186, 189, 504 of the Indian Penal Code.
The allegation has been made that when the police received information that two groups of people were quarreling each other, they reached there and tried to pacify the matter upon which members of both groups became agitated and quarreled with the police party and encircled the police personnel and attacked with lathi, danda and brick on police force with an intent to kill and tried to snatch firearms from the police party. However, learned counsel for the petitioners submits that there is no specific allegation against them. Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs.
10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate1st Class, Jehanabad in connection with Kako P.S. Case No. 323 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Patna High Court CR. MISC. No.15419 of 2019(2) dt.13-03-2019 3/3 themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
