The petitioner apprehends her arrest in Dhaka P.S. Case No.99 of 2016 registered under Sections 420, 467, 468, 471, 387, 120(B) and 34 of the Indian Penal Code. The complainant alleged that sister of her father was married to Sk. Safiullah who got no issue and she executed deed of Will in favour of complainant and her brothers and sister-inlaw. Sk. Atiullah (brother of Sk. Safiullah and husband of Bibi Mehrunesa) got 1⁄2 share but the petitioner being daughter of Sk. Atiullah got the land falling in the share of Bibi Mehrunesa from her mother.

Learned counsel for the petitioner submits that the dispute is of purely civil nature. The petitioner got the land from her mother. The petitioner neither committed any forgery nor

Having considered the facts and the nature of allegation and the fact that the dispute is of civil nature, the above named petitioner, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dhaka, East Champaran in connection with Dhaka P.S. Case No.99 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
