JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Baruraj P.S. Case No. 41 of 2018 registered for the offences punishable under Sections 147, 148, 149, 366A, 302, 201 and 120B of the Indian Penal Code.

Allegation as per complaint petition, on the basis of which FIR was registered, is that minor daughter of the informant as well as daughter of her Gotni had gone to Bazar and thereafter they did not return. It is further alleged that on the next day their dead bodies were found hanging in the orchard. Further allegation is that petitioner and other accused persons suggested the complainant/informant to dispose of the dead bodies and as such the dead bodies were disposed of. Submission of learned counsel for the petitioner is that an FIR has also been lodged by the local Chaukidar with

Patna High Court CR. MISC. No.13814 of 2019(6) dt.30-07-2019 2/2 respect to the dead bodies being found in orchard and he suspected hands of the family members of the deceased. Further submission is that petitioner is co-villager of the informant and at best there is allegation against him is that he co-operated and instigated in disposal of the dead bodies and except that there is nothing against him in the FIR.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Ms. Priti Kumari, Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Baruraj P.S. Case No. 41 of 2018, G.R. No. 621 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
