Petitioner seeks bail in Nadi P.S. Case No.34 of 2019 registered under Sections 366A, 376 and 34 of the IPC and under sections 4 and 6 of the POCSO Act.

The informant alleged that one Chandan Kumar, who was acquainted with her, came to her house and with the help of the petitioner Ram Pravesh, Shrawan Kumar and Sahdeo, Chandan kidnapped her and committed rape with her. Learned counsel for the petitioner submits that the victim was having love affairs with Chandan Kumar and she fled away along with Chandan Kumar. The petitioner has no manner of concern with the love affairs of Chandan Kumar and the victim. Similarly situated co-accused Shrawan Kumar has

Having considered the facts that it was Chandan Kumar, who is said to have established physical relation with the victim, and the petitioner and others are alleged to have accompanied Chandan Kumar and the co-accused Shrawan Kumar has already been granted bail, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned Additional District & Sessions Judge 1st-cum-Special Judge, Supaul in connection with Nadi P.S. Case No.34 of 2019.
